e-Voting means an electronic process for collating and registering voters’ details, online casting of votes and recording of votes casted by the members using a computer based machine to display the number of votes polled in favour or against such that the entire voting gets registered and counted in an electronic registry in a centralized server.

 Disclosure of Personal Information: The User agrees that World e-voting platform can use, hold or

process its Personal Information on computer or otherwise in connection with e-Voting as well as

for statistical, public and election analysis. Similarly, the User also agrees that World e-voting platform     may as a matter of necessity disclose, in strict confidence, to other relevant institutions, such Personal Information as may be reasonably necessary for reasons inclusive of but not limited to any of the following:

Proprietary Rights: The User acknowledges that the software underlying e-voting is the legal property of World e-voting platform. The permission given by the owner to access e-voting will not convey any proprietary or ownership rights in the above software. The User shall not attempt to modify, translate, disassemble, decompile reverse or Re-engineer the software or create any derivative product based on that software.

Access Fees: Users can only access the site upon payment of Access fees. [access fee is one off payment]

Mobile APP Fees: Client must make payment for Mobile APP to enable provision of Mobile APP service.

Also all installers of mobile app shall be charged a token of the sum of $1 only.

Log on Details: Access code, Username and Password are issued upon receipt of access fees.

Annual Subscription: Subscriptions are paid annually, with or without election. Failure to renew subscriptions will lead to disconnection of user’s access.

Payment: All payments are made through Ecobank and Sterling bank deposit with evidences of such payment uploaded for confirmation purpose.

Direct Payment: Direct payments can only be made for wallet upload [SMS PURCHASE].

Management Principle: it is mandatory at client expense for a minimum of 2 of our technical personnel to witness elections conducted by users. The technical team is to be present 2 days before and 2 days after election to ensure election success.

Safeguards:

The User agrees to safe guard her LOG IN DETAILS.

The User agrees to keep the LOG IN DETAILS confidential and not to reveal it to any third party.

The User agrees they shall be responsible for the privacy of their password.

The User agrees that they shall not let any unauthorized person to have access to their systems or leave them unattended while accessing World e-voting platform.

Ongoing elections: Elections/voting once commenced cannot be stopped midway by any court injunction, local, state or federal government order or by the election organizing committee/body.

Global view: Elections conducted on our platform are being viewed and watched online at Worldevotingplatform.com and cannot be made secret.

Change of Terms and Conditions: World e-voting platform. has absolute right to amend or supplement any of the terms and conditions at any time. We will endeavor to give prior notice of a minimum of 21 days or more to the general users wherever such changes become inevitable. We may introduce additional new services into e-voting from time to time. The existence and availability of a new service will be notified to the Users as and when it becomes available. The changed terms and conditions applicable to the new features in e-voting shall be communicated to Users. By using these new services, the User agrees to be bound by the revised terms and conditions as may be applicable. The availability or non-availability of a particular service within the e-voting platform shall be advised either through email, web page of World e-voting platform or written communication.

Non-Transferability: The right of use of e-voting service is not transferable by a User under any circumstance and shall be used by the concerned and approved User only.

Liability: World e-voting platform shall not be liable to the User for any other activities executed on the e-Voting system. The User hereby fully indemnifies us against any action, suit, proceedings initiated against it or any loss, cost or damage incurred by it as a result thereof. We shall under no circumstance be liable to the User if the access is not available in the desired manner for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure or any other reason beyond our control. Under no circumstance shall We be liable for damages whatsoever whether such damages are direct, indirect, incidental, consequential and irrespective whether any claim is based on loss of revenue, interruption of business, or any loss of any character or nature and whether sustained by the user or any other person. Illegal or improper use of our e-voting platform shall render the User liable for payment of financial charges as decided by Us and may result in suspension of the access to our e-voting platform.

Governing Laws: These terms and conditions and or the use of the services provided through e-voting shall be governed by the laws of the User country. The User agrees to submit to the exclusive jurisdiction of any Courts located in their country as regards any claims or matters arising under these terms and conditions. Any dispute or differences arising between both parties shall be settled by mutual consultation or discussions, failing which the same shall be referred to arbitration. The Arbitration proceedings shall be governed and conducted in accordance with the country Arbitration and Conciliation Act and that the Arbitration proceedings shall take place in the host country. evotingplatform.com accepts no liability whatsoever, direct or indirect, for non-compliance with the laws of any country other than the host country. The mere fact that e-Voting can be accessed through Internet by a User in a country other than host country shall not be interpreted to imply that the laws of the said country govern these terms and conditions.
